These terms keep things clear between you and Jawbly. Please read them, they explain what you can expect from us and what we ask of you.

Agreement to these terms

These Terms & Conditions (“Terms”) govern your access to and use of Jawbly (“Jawbly”, “we”, “us”). By creating an account or using the service, you agree to these Terms. If you are using Jawbly on behalf of a business, you confirm you are authorised to bind that business.

The service

Jawbly is a platform for building and running AI assistants on WhatsApp that can answer customers, book appointments, capture leads and take orders, with a dashboard to manage it all.

We may add, change or remove features over time to improve the service. We’ll aim to give reasonable notice of significant changes.

Accounts and eligibility

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account and for your team members’ use of the service.

You must be legally able to enter into these Terms and use Jawbly only for lawful business purposes.

Acceptable use

You agree not to use Jawbly to:

  • Send spam or unsolicited messages, or otherwise violate WhatsApp’s and Meta’s policies, including the WhatsApp Business Messaging Policy and Meta’s Commerce Policy.
  • Sell, promote or facilitate goods or services prohibited or restricted by Meta, including illegal or recreational drugs, weapons, ammunition and explosives, tobacco and vaping products, alcohol where restricted, adult or sexual content, dating services, gambling, and unlicensed financial, medical or supplement products.
  • Share unlawful, harmful, deceptive, or infringing content.
  • Impersonate others or misrepresent your affiliation, including implying an endorsement by or affiliation with WhatsApp or Meta.
  • Attempt to disrupt, reverse engineer, or gain unauthorised access to the service.
  • Collect or use personal data unlawfully.

You are responsible for the content your assistant sends and for complying with all laws and platform rules that apply to your business. We may suspend or remove any account that breaches these rules to protect the service and our compliance with Meta.

Your content and data

You retain ownership of the content and data you put into Jawbly, including your assistants, catalog, and customer conversations. You grant us the limited rights needed to operate the service for you (for example, to store data and generate replies).

You are responsible for having the rights and consents needed to process your customers’ data through Jawbly.

Plans, billing and credits

Paid plans are billed in advance on a recurring basis. Your plan includes a monthly allowance; you can also buy credits, which do not expire.

  • Plan allowances reset each billing period and do not roll over.
  • Purchased credits remain available until used.
  • Prices may change; we’ll give notice before changes affect you.
  • Taxes may apply based on your location.

Except where required by law, payments are non-refundable. You can cancel anytime; cancellation takes effect at the end of the current billing period.

WhatsApp and third parties

Jawbly relies on the WhatsApp Business Platform and other third-party services. Your use of WhatsApp is also subject to Meta’s terms and policies, and we are not responsible for third-party services outside our control.

Intellectual property

Jawbly, including its software, design and brand, is owned by us and protected by law. These Terms do not grant you any rights to our intellectual property except the right to use the service as permitted here.

Disclaimers

The service is provided “as is” and “as available”. AI-generated responses may occasionally be inaccurate, and you are responsible for reviewing how your assistant is configured. To the extent permitted by law, we disclaim warranties not expressly stated in these Terms.

Limitation of liability

To the maximum extent permitted by law, Jawbly will not be liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim.

Suspension and termination

You may stop using Jawbly at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or fail to pay. Where reasonable, we’ll give notice and a chance to fix the issue.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we’ll update the date above and notify you where appropriate. Continuing to use Jawbly after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws applicable at Jawbly’s place of business, without regard to conflict-of-law rules. Disputes will be handled by the competent courts there, unless mandatory local law provides otherwise.
